1. Acceptance of Terms

By accessing and using Creatoc (the "Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Platform.

2. User Accounts

To use certain features of the Platform, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Content and Ownership

You retain ownership of the content you upload to the Platform. However, by uploading content, you grant Creatoc a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content in connection with the Platform's services.

4. Prohibited Activities

You agree not to use the Platform for any illegal purposes or to distribute content that is defamatory, infringing, or otherwise harmful. We reserve the right to terminate accounts that violate these prohibitions.

You may not use Instagram automation features for spam, deceptive engagement, unsolicited messaging, unlawful content, harassment, impersonation, credential collection, or any activity that violates Meta or Instagram rules, applicable law, or the rights of others.

5. Instagram and Meta Integrations

Instagram-connected features require a valid Instagram professional account and authorization through Meta or Instagram. By connecting Instagram, you authorize Creatoc to access and process the Instagram data and permissions needed to provide the features you choose to use.

You are responsible for ensuring your use of automations, comments, messages, content delivery, and connected account data complies with Meta's terms, Instagram's rules, and applicable law. Creatoc may limit, suspend, or disable Instagram-connected features where necessary to protect users, comply with platform rules, prevent abuse, or respond to revocation, token expiry, review requirements, or API limitations.

Instagram and Meta names, logos, and trademarks belong to their respective owners. Creatoc is not endorsed by Meta or Instagram unless expressly stated by Meta.

6. Data Deletion and Disconnection

You may disconnect Instagram from Creatoc or revoke Creatoc's access from your Meta or Instagram account settings. You may also request deletion of your account, workspace, connected Instagram account data, and Meta-derived data by contacting [email protected]. Deletion requests are handled according to our Privacy Policy and applicable law.

7. Payments, Withdrawals, and Payout Providers

Creators must provide accurate legal name, business type, PAN, address, contact, and bank account details before receiving eligible payouts through Creatoc. Payout setup is required before withdrawal availability.

Creatoc may use third-party payment and payout processors, including Razorpay, to verify payout information, support compliance checks, and process eligible creator payouts. Payout availability does not guarantee instant withdrawal or immediate settlement.

Creatoc may delay, block, reverse, withhold, or disable payouts where needed for verification, compliance, fraud prevention, chargebacks, disputes, provider requirements, tax, accounting, or legal reasons. Fees, taxes, documentation, and other compliance obligations may apply to your payout activity.

8. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice.

9. Limitation of Liability

Creatoc is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

10. Governing Law

These terms are governed by and construed in accordance with the laws of the jurisdiction in which Creatoc is headquartered.

11. Changes to Terms

We may update these Terms and Conditions from time to time. We will notify you of any changes by posting the new terms on this page.
